Terms and Conditions

These terms and conditions govern all sales made on dinnerisservedparis.com between Océane Hu, sole trader (hereafter "Dinner is served", "the House" or "the Seller"), and any private individual making a purchase (hereafter "the Client"). Every order implies full acceptance of these terms, which the Client acknowledges having read before placing the order.

Article 1 — The pieces

Dinner is served offers pre-owned, vintage and archival luxury pieces, such as bags, accessories and garments. Each piece is unique. The essential characteristics, condition and authenticity of each piece are described on its page, with photographs. As the pieces are pre-owned, they may show signs of use, described honestly on each page.

Article 2 — Prices

Prices are shown in euros, all taxes included. The mention "VAT not applicable, article 293 B of the French General Tax Code" applies. Shipping costs are shown before the order is confirmed. The Seller may change prices at any time; the price applied is the one in force at the time of the order.

Article 3 — Orders

The sale is concluded once the Client confirms the order after accepting these terms, and receives a confirmation e-mail. As each piece is unique and available in a single example, its sale removes it from the catalogue.

Article 4 — Refusal or cancellation of an order

The Seller may refuse or cancel an order in case of unavailability of the piece, a suspicion of fraud, or a previous dispute with the Client. Where an order is cancelled by the Seller, the Client is refunded in full.

Article 5 — Errors in price or description

Despite our care, the site may occasionally contain an error in a price or a description. The Seller reserves the right to correct such errors and to cancel an order placed at a manifestly incorrect price, even after confirmation. In that case, the Client is informed and refunded in full.

Article 6 — Payment

Payment is made at the time of the order, through the means offered on the site. The order is processed only after payment is confirmed.

Article 7 — Delivery

Pieces are shipped tracked and insured to the address given by the Client. Delivery times are stated at the time of order. Failing any indication, delivery takes place within 30 days maximum. The Client must check that the delivery address is correct; a parcel returned for an incomplete address may incur re-shipping costs.

Article 8 — Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, the Client has fourteen (14) days from receipt of the order to exercise the right of withdrawal, with no reason required. To do so, the Client informs the Seller by an unambiguous statement, by e-mail to contact@dinnerisservedparis.com, using the model withdrawal form below.

The Client returns the piece without delay and within 14 days of the decision, in the condition in which it was received, with its protections and original packaging. The direct cost of return is borne by the Client. Returns must be sent tracked and insured.

The Client may be held liable for any depreciation of the piece resulting from handling beyond what is necessary to establish its nature, characteristics and proper functioning. Where a piece is returned incomplete, without its original packaging, or in a condition that goes beyond such handling, the Seller may reduce the refund in proportion to the depreciation. Where the condition of the returned piece is such that the withdrawal is manifestly abusive, the Seller may refuse the return.

The Seller refunds all sums paid, including the original delivery costs, within 14 days of being informed of the withdrawal, using the same means of payment. The Seller may withhold the refund until the piece is recovered or proof of its return is provided.

Article 9 — Legal guarantees

The consumer has a period of two years from delivery of the goods to obtain the benefit of the legal guarantee of conformity in the event of a defect of conformity. For second-hand goods, the Client benefits from a twelve-month presumption that the defect existed at delivery. The legal guarantee of conformity arises from articles L217-1 to L217-32 of the French Consumer Code. The Client also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. Article 10 — Authenticity

Each piece is verified through the process described on the Authentication page. In the exceptional event that a piece sold by Dinner is served were found to be inauthentic, it is taken back and refunded in full, return shipping at the Seller's expense.

Article 11 — Orders outside the European Union

For orders shipped outside the European Union, prices are shown excluding import taxes. Any customs duties, import taxes and clearance fees are charged separately by the carrier and are the responsibility of the Client. If a parcel is refused or returns to us because these charges have not been paid, any fees passed on to us may be deducted from the refund.

Article 12 — Liability

The Seller cannot be held liable for indirect damages arising from the purchase or use of a piece, nor for delays or failures caused by circumstances beyond its reasonable control. The Seller's liability is limited to the price of the piece concerned. Nothing in these terms limits the Client's legal rights as a consumer.

Article 13 — Third-party links

The site may contain links to third-party sites, such as our social media. The Seller is not responsible for their content or their practices, and invites the Client to review their own terms and policies.

Article 14 — Personal data

The processing of personal data is described in the Privacy Policy.

Article 15 — Governing law

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first.
